PIP Can Follow the Person Before the Vehicle
People often assume the driver’s insurance pays every passenger’s medical bills. New Jersey PIP does not always work that way. The passenger’s own policy, or a policy covering the passenger as a resident family member, may have priority even though that policy did not insure the vehicle involved.
A resident relative is generally a family member connected to the insured household under the policy definition. Residence can be fact-sensitive, especially for students, separated families, and people who divide time between homes.
No Car Does Not Necessarily Mean No Auto Policy
The passenger may not own a vehicle but may live with a parent, spouse, child, sibling, or another relative who does. That household policy must be obtained and read. A verbal statement that the passenger is ‘not listed’ may not resolve whether the policy defines the passenger as an insured.
The investigation should also ask whether the passenger recently sold a car, was named on another policy, or was excluded by an endorsement. Each fact can affect priority or coverage.
The Occupied Vehicle May Become Relevant
If no personal or household policy provides PIP, coverage on the vehicle carrying the passenger may apply under New Jersey law and the policy. Commercial vehicles, buses, taxis, rideshare vehicles, employer vehicles, and out-of-state policies can introduce additional rules.
When no applicable policy can be found, the New Jersey Property-Liability Insurance Guaranty Association may administer benefits for a qualified claimant. That is not automatic fallback insurance. Eligibility, exclusions, notice, and application requirements must be satisfied.
Make a Coverage Chart Early
I list every potentially relevant person, household, vehicle, carrier, and policy number. Then I compare the priority rules and request written positions from the carriers. That is faster and safer than sending the same bill to several companies and hoping one pays.
The PIP carrier handles medical benefits. The liability claim against the careless driver is a different part of the case. Identifying the correct PIP policy does not decide fault or the value of the passenger’s injury claim.
