What Is an Assignment of PIP Benefits?

An assignment of PIP benefits is a written agreement allowing a medical provider to pursue payment directly from the patient's automobile insurer for covered accident care. The provider can submit bills, appeal denials, and often bring PIP arbitration in its own name, subject to the assignment and law. The assignment does not increase coverage or make every charge payable. It can also affect who controls the billing dispute and what the provider may collect from the patient, so the form should be read before it is signed.

Mike’s Quick Answer

An assignment of PIP benefits is a written agreement allowing a medical provider to pursue payment directly from the patient’s automobile insurer for covered accident care. The provider can submit bills, appeal denials, and often bring PIP arbitration in its own name, subject to the assignment and law. The assignment does not increase coverage or make every charge payable. It can also affect who controls the billing dispute and what the provider may collect from the patient, so the form should be read before it is signed.

The Patient Transfers a Limited Payment Right

An assignment does not transfer the entire personal injury claim. It generally transfers the right to seek specified PIP medical benefits for the provider’s services.

The exact language matters. Some forms authorize appeals, arbitration, records, attorney selection, or endorsement of checks. Broad forms deserve the same attention as any other contract.

The Provider Can Fight Its Own Bill

Providers understand coding, treatment, medical necessity, and their records. An assignment lets them challenge fee reductions or denials without requiring the patient to finance the dispute.

The provider may retain PIP counsel and pursue arbitration. The patient can still be asked for cooperation, testimony, documents, or an examination when relevant.

Assignment Does Not Eliminate Every Patient Charge

A valid deductible, copayment, exhausted benefit, noncovered service, or other lawful amount can remain the patient’s responsibility. An improper balance bill may not.

The assignment, provider agreement, EOB, and denial reason should be read together. Neither ‘assigned’ nor ‘denied’ answers the entire billing question.

Coordinate the PIP and Injury Cases

The provider’s arbitration can affect outstanding bills, testimony, and medical records. The bodily-injury lawyer should know whether the dispute is pending and what the provider claims.

I track assignments and PIP cases so closing figures do not pay a bill twice or ignore a real obligation. The provider controls the assigned payment claim; the client still controls the personal injury settlement. Those are related financial issues, but they are not the same case.

Frequently Asked Questions

Do I have to sign an assignment of benefits?

A provider may condition its billing arrangement on one, but the patient can read it, ask questions, and consider alternatives before signing.

Can I revoke the assignment?

That depends on the form, services, provider reliance, and law. Revocation may not undo rights already exercised or payment already pursued.

Does the assignment let the provider settle my injury case?

No. A PIP assignment ordinarily concerns medical-benefit payment, not the patient’s separate liability claim.
