Look Beyond Medical Bills for PIP Income Benefits

PIP income benefits may help replace part of the earnings lost because of an automobile injury. New Jersey policies can also provide essential-services benefits for qualifying replacement help at home. These benefits are separate from medical-expense coverage. I review the coverage actually purchased and the supporting facts before advising a client what can be claimed.

A careful policy review can uncover benefits that help with lost income and the everyday demands of recovery. People understandably focus on medical bills after a crash. They may not realize that another part of the policy could address a different immediate need. The declarations page and endorsements are worth examining before assuming the medical claim is the only available benefit.

The amounts may be limited, but a benefit does not have to replace an entire salary to matter. It should be identified and pursued where the coverage and facts support it. At the same time, I want the client to understand the limit so that a modest insurance benefit is not mistaken for complete financial protection during a lengthy recovery.

Quote about PIP income benefits — Michael B. Fusco, Esq.: “A careful policy review can uncover benefits that help with lost income and the everyday demands of recovery.”

Confirm the Selected Coverage and Its Limits

The New Jersey Department of Banking and Insurance describes a standard extra-PIP package with income continuation of up to $100 per week and a $5,200 total limit. Its planner describes essential-services benefits of up to $12 per day and $4,380 in total. These are limited benefits, not a promise that every policy includes them or that every claimed expense qualifies.

Consumers may have selected different available options or declined the package. The policy in force for the accident must therefore be obtained. A current renewal document may not show what was purchased for an earlier period. Ask for the relevant declarations and endorsements rather than relying only on what appears in an insurer's app today.

I also distinguish a weekly limit from a total limit. A policy may restrict both how much can be paid during a period and the overall benefit. Understanding those provisions helps explain why a payment may be smaller than the actual loss. The calculation should be checked against the selected coverage and the documentation supplied.

PIP income benefits can interact with other sources of payment. Temporary disability or another applicable benefit may affect the amount payable under the governing rules. Provide the award notices and payment history so counsel can evaluate coordination. The objective is to pursue the benefits properly available while avoiding an assumption that the same loss can always be paid twice.

Document the Work Loss and Its Medical Basis

An income claim needs an explanation of why the injury prevented the relevant work. The provider's assessment should relate to the person's actual duties and the period involved. A restriction affecting repeated lifting may have a different effect on a warehouse job than on a job with different demands. Accurate job information helps make the medical opinion understandable.

Payroll and attendance records can support the dates missed and the earnings involved. If you used paid leave, identify it. If your hours were reduced rather than eliminated, explain that as well. These details can affect how a benefit is calculated and how the broader loss is evaluated. A simple statement that you “could not work” may leave important questions unanswered.

Self-employment can require additional documentation because business receipts do not necessarily equal personal net income. The records should explain what work could not be performed and how the loss was calculated. A seasonal business may require context about the relevant period. Where professional accounting assistance is needed, that should be identified rather than replaced with an unsupported estimate.

Keep your lawyer informed when your work status changes. A return to work may end one claimed period while leaving another issue to evaluate, such as reduced duties or an ongoing limitation. The records should follow the actual recovery. We can explain a change more effectively when the dates and reasons are recorded close to the time it occurred.

Essential Services Address Qualifying Help at Home

Essential-services coverage concerns necessary replacement services ordinarily performed by the injured person. The question is not simply whether help would make life easier. We need to identify the task, the accident-related inability and the expense incurred for the substitute service. The selected limits and governing requirements then determine what may be reimbursed.

For example, if an injury prevents a household task you previously performed, preserve the invoice for qualifying replacement help. A useful record identifies the service date and what was done. If a charge covers several unrelated tasks, the portion connected to the injury may need clarification. Clear documentation helps an insurer evaluate the actual request.

Help from relatives can raise a different question from an outside paid service. Do not create a receipt for money that was never paid or an expense that was never incurred. Describe the arrangement honestly. Counsel can evaluate whether any compensable expense exists and how the assistance may otherwise be relevant to explaining the effect of the injury.

The medical record should also support the functional restriction where required. You do not need to ask your doctor for a legal conclusion. Explain the task and the difficulty you are experiencing. The provider can give the appropriate medical assessment, and counsel can apply that information to the benefit requirements.

Follow the Claim Through to a Written Decision

Ask the insurer which forms and supporting materials are required for PIP income benefits or essential services. Record when they were submitted and keep complete copies. A medical claim number does not necessarily mean every nonmedical benefit has been requested. Confirm that the insurer understands the particular benefit being sought.

If an item is missing, identify it promptly. If the claim is denied or paid in a reduced amount, request the explanation and preserve the correspondence. The reason may involve eligibility, the medical proof or the calculation. Those questions require different responses, and a written explanation gives counsel something concrete to review.

The amount paid through PIP should be kept separate from the evaluation of the liability claim. An unpaid loss is not automatically recoverable from another driver; the applicable law, fault and evidence still matter. But the limited amount of a particular first-party benefit should not end the investigation of the person's overall injury and financial harm.

Bring the policy and the available work or household-service records to the discussion. I can help identify the coverage questions and the evidence needed to present the request. The purpose is to make practical benefits available where they apply, while developing a complete and accurate picture of the losses the accident caused.
